Your Responsibility

You acknowledge that depending on the nature of the Tour booked, or the location(s) in which such Tour operates, there may be a significant degree of personal risk involved in travel on the Tour. There are dangers inherent to adventure travel generally and you acknowledge you have considered such risk to health and safety and are willing to assume it, by confirming your booking such Tour. You acknowledge that you have considered the potential risks, dangers and challenges in light of your own personal capabilities and needs, and expressly assume the risks attendant to travel under such conditions. You acknowledge and agree that Pearl Career Solutions Pvt. Ltd. is not liable / responsible for providing information or guidance to you with respect to local customs, weather conditions, specific safety concerns, physical challenges or laws in effect in any locations where such Tours are operated.

You will have to strictly follow the tour program and comply with the Terms and Conditions of the various contractors / service providers. You are liable /responsible to register with Pearl Career Solutions Pvt. Ltd. representative at the appointed date, place and time for departure and you would be treated as a no-show if you fail to do so and the consequences shall be entirely yours.

You are required to be punctual and adhere to the time-lines of the tour and of the contractors / service providers. If you are not punctual, you could miss your flight, transport, sightseeing etc. Pearl Career Solutions Pvt. Ltd. will not be liable / responsible in any way in such situations.

You shall not behave in a manner which may cause distress or annoyance to other tour participants or to any other person or which may create the risk of danger or damage to property belonging to Pearl Career Solutions Pvt. Ltd. or other tour participants, service providers or any other persons.

You shall not carry any item or object, the possession of which is forbidden by any law, rules or regulations. Nor shall you violate any other law, rules or regulations. Should any tour participant misbehave or violate any laws, rules or regulations, Pearl Career Solutions Pvt. Ltd. shall have the right to discontinue his / her participation and exclude him / her from the tour at his / her risk, cost and expense. Should Pearl Career Solutions Pvt. Ltd. suffer any damage or liability on account of a tour participant’s misbehavior, Pearl Career Solutions Pvt. Ltd. shall be free to separately charge and recover the losses and expenses from him / her.

Health and Fitness

Participants must be in good health and in a good physical condition. It is vital that participants with medical problems make them known to us well before departure. If you suffer from severe muscular, chest, heart or bronchial disorders, or if you are a severe asthmatic, or have high blood pressure, you are strongly advised against participating. Our trips generally take place in remote areas where there is little or no access to normal medical services or hospital facilities for serious problems. Where necessary, evacuation can be prolonged but it is difficult and expensive. Medical and evacuation expenses will be the responsibility of the participant.

If Pearl Career Solutions Pvt. Ltd Cancels a Trip

If Pearl Career Solutions Pvt. Ltd. has to cancel a trip due to insufficient bookings, you will receive a full refund. Pearl Career Solutions Pvt. Ltd. is not responsible for any additional expenses incurred by the participants in preparation for the trip. However, you will not be entitled to make any further claim for any injury, loss, expenses or damage (either direct or consequential) or for any loss of time or inconvenience which may result from such cancellation (including but not limited to visa, passport and vaccination charges, or departure, gear purchases, airport and airline taxes).

Health

Our Tour Leaders take their responsibilities seriously and if a Tour Leader believes in his/her judgment that you should not participate in the trip, before your departure, even if you pass your medical, he/she may exclude you from the trip. In this circumstance you will be offered the option of taking another trip considered suitable for you or a full refund. If during a trip the Tour Leader considers you should not participate further he/she may direct you not to continue and you must follow the Tour Leader’s instructions. In this case you will not be entitled to any refund. Travel insurance may compensate you depending on the circumstances.

Changes in Package

Pearl Career Solutions Pvt. Ltd. may for any reason change the date of departure or conclusion of the tour, or it is possible that a route change, postponement or delay (either in relation to departure or to the duration of the expedition) may become necessary due to inclement weather, snow and ice conditions, political restrictions or any other cause. In the event of a change, postponement or delay, participants have no right to refund of the tour price (in whole or in part) or other compensation for any injury, loss or damage.

Package prices are based on ground costs, airfares and exchange rates. Pearl Career Solutions Pvt. Ltd. tries its utmost not to increase tour prices (in full or part), however sometimes increases are outside its control. We reserve the right to amend tour prices (or any part) without notice at any time before and including the departure date. Amendments may be necessitated for many reasons including, but not limited to, exchange rate fluctuations, increased fuel costs, airfares, airport charges etc. Any increase in tour prices must be paid prior to the departure date.

Unused Services

It is clearly understood that there shall be no refund or compensation whatsoever for unused / unutilized services. This general rule applies to all kinds of non-utilization or under-utilization of tour services, whether of the whole or part of the tour and whether as a matter of your choice, or caused by your fault or compelled by circumstances such as ill-health, weather, external factors etc.

As a consequence of the above rule, please note that no refund will be admissible in the following circumstances (amongst others).

• If you fail to join the group at the commencement of the tour or join the group later or leave the group before culmination of the tour for any reasons whatsoever.

• If you fail to or are unable to utilize any of the services on the tour like airline travel, hotels, sightseeing, rides, cruises, meals, entrance fees, optional tours etc. due to any reason whatsoever such as late reporting, ill-health etc.

• If you terminate your participation in the tour due to your own fault, negligence or breach of these Terms.

Acceptance of Risk

Accommodation, transportation, activities and excursions and other components of Adventure Tours offered by Pearl Career Solutions Pvt. Ltd. will be arranged with local suppliers to the region where the Tour operates, who may themselves engage the services of local operators and/or sub-contractors. Pearl Career Solutions Pvt. Ltd. at all times endeavors to appoint reputable and competent local suppliers and to comply with all applicable laws and regulations concerning health and safety in the regions where tours operate. The terms and conditions of all suppliers of Tour/s will be applicable to the Tour provided by such supplier and are expressly incorporated into these Terms and Conditions. These may limit or exclude liability of the supplier.

The liability of Pearl Career Solutions Pvt. Ltd. will not exceed that of any supplier of any Tour component. The components that make up each tour shall be regarded as having been satisfactorily performed and delivered solely in reference to the regulations and laws concerning health and safety in the applicable jurisdiction where such component is operated.

Indemnity

You hereby indemnify Pearl Career Solutions Pvt. Ltd and undertake to keep Pearl Career Solutions Pvt. Ltd indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by Pearl Career Solutions Pvt. Ltd to a third party in settlement of a claim or dispute on the advice of Pearl Career Solutions Pvt. Ltd legal advisers) incurred or suffered by Pearl Career Solutions Pvt. Ltd arising out of any breach by you of any provision of these terms and conditions, or arising out of any claim that you have breached any provision of these terms and conditions].

Breaches of these terms and conditions

Without prejudice to Pearl Career Solutions Pvt. Ltd other rights under these terms and conditions, if you breach these terms and conditions in any way, Pearl Career Solutions Pvt. Ltd may take such action as Pearl Career Solutions Pvt. Ltd deems appropriate to deal with the breach, including suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you.

Variation

Pearl Career Solutions Pvt. Ltd may revise these terms and conditions from time-to-time. Revised terms and conditions will apply to the use of this website from the date of the publication of the revised terms and conditions on this website. Please check this page regularly to ensure you are familiar with the current version.

Assignment

Pearl Career Solutions Pvt. Ltd may transfer, sub-contract or otherwise deal with Pearl Career Solutions Pvt. rights and/or obligations under these terms and conditions without notifying you or obtaining your consent.

You may not transfer, sub-contract or otherwise deal with your rights and/or obligations under these terms and conditions.

Severability

If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

Entire agreement

These terms and conditions [together with [Documents]] constitute the entire agreement between you and Pearl Career Solutions Pvt. Ltd in relation to your use of this website, and supersede all previous agreements in respect of your use of this website.

Law and jurisdiction
